The defense team of former Philippine President Rodrigo Duterte plans to continue seeking his temporary release despite the Appeals Chamber of the International Criminal Court denying their earlier motion. Duterte’s lawyer, Atty. Nicholas Kaufman, said the effort has not ended and that the legal team is preparing another request.
Kaufman said they are currently waiting for Duterte’s medical evaluation, which will assess both his physical and cognitive condition. The defense maintains that Duterte, now 80 years old, is no longer a flight risk and does not pose a threat to witnesses due to his declining health. Kaufman said the results of the evaluation will form a key part of their renewed motion for interim release.
According to Kaufman, the ICC has not affirmed any interim release requested by individuals facing charges of crimes against humanity. He noted that while this remains the court’s track record, the defense intends to move forward with the process once the medical results are available.
The Appeals Chamber dismissed the earlier motion, prompting the defense to strengthen its arguments for another attempt. The team is expected to submit a new filing after reviewing the medical findings to show Duterte’s health status and suitability for temporary release.
Kaufman emphasized that the defense will continue following ICC procedures as they work to secure Duterte’s release while the case proceeds. No timeline has been announced for when the new motion will be filed, as it depends on the completion of the medical assessment.
The case remains active before the ICC, and the defense has reiterated that their efforts will continue despite past denials.
