The lead counsel of former Philippine President Rodrigo Duterte is set to challenge the legality of his arrest and extradition to the International Criminal Court (ICC). British-Israeli lawyer Nicholas Kaufman argues that Duterte’s rights have been “completely denied” in the Philippines, making his case for defense stronger.
Kaufman insists that Duterte should be allowed to return home immediately, labeling his detention as “illegal.” His legal team is expected to contest the procedures that led to the former president’s current situation, claiming violations of due process under international law.
On the other hand, ICC-listed counsel and drug war victims’ lawyer Atty. Gulbert Andres asserts that Duterte’s arrest will not impact the trial. Citing international law doctrine, Andres emphasized that proceedings against Duterte will continue regardless of his detention status.
This legal battle adds another layer to the controversy surrounding Duterte’s alleged human rights violations during his presidency. With both sides gearing up for a fight, the world watches as the former leader’s fate unfolds.
