The Commission on Elections (COMELEC) First Division has dismissed the petition seeking to disqualify the Bagong Henerasyon (BH) party-list.
On Monday, BH and Duterte Youth were not proclaimed winners despite winning, due to pending petitions.
The petition stemmed from alleged partisan activities by its nominees.
According to the poll body’s resolution, the petitioners failed to comply with documentary requirements.
Rules require the petitioners to give the respondents copy of the petition through personal service but records show however that the petitioners sent the copy via registered mail.
The same rule states that if the respondents refuse to receive the copy through the personal service the incident should be mentioned through an affidavit.
The petitioners also failed to attach in their petition copy of the respondent’s Certificate of Nomination- Certificate of Acceptance of Nomination (CON-CAN).
Despite the dismissal of the petition, BH party-list still cannot be proclaimed yet.
COMELEC chairperson George Garcia said this can only proceed if there is already a final and executory decision.
Prior to this, Garcia assured that they will resolve pending petitions for BH and Duterte Youth before June 30.
