The Muntinlupa Regional Trial Court Branch 205 has partially granted Vic Sotto’s petition for the issuance of Writ of Habeas Data against Darryl Yap in connection with the Pepsi Paloma movie.
Under the ruling, the 26-second teaser of the movie is ordered removed from all online platforms.
Despite this, the Court still allowed Yap to continue with the production and release of the movie.
Because of this, Sotto’s lawyer, Atty. Enrique Dela Cruz, thanked the court for the decision and called for the immediate removal of promo materials containing Vic Sotto’s name.
Meanwhile, on Yap’s side, his lawyer, Atty. Raymond Fortun, said that they will not appeal the decision for now especially since the Court did not stop the production and release of the movie.
Fortun also hope that the gag order imposed on both parties will continue.
Sotto has filed 19 counts of cyber-libel complaints against Yap before the Muntinlupa Prosecution Office after the teaser of the Pepsi Paloma movie went viral.
The characters in the teaser named Sotto as the one who allegedly raped the late sexy star.
Paloma was one of the popular sexy girl-group called “Softdrink Beauties” introduced in the 1980s along with Sarsi Emmanuel, Coca Nicolas and Myra “Mirinda” Manibog.
