Diniskwalipika ng Commission on Elections (Comelec) ang kandidato bilang Punong Barangay ng Cabas-an, Aroroy na si Aniano Pancho Capinig sa 12-pahinang desisyon ng Comelec.
Binigyan diin ng Comelec na may matibay na basehan ang mga alegasyon ng petitioner na si Eduardo Padre Morado laban kay Capinig.
Sa naturang Resolution, lumabas na lumabag si Capinig sa Omnibus Election Code Section 2 ng Comelec na nakasaad : “Any person who has been declared by competent authority insane or incompetent, or has been sentenced by final judgment for subversion, insurrection, rebellion or for any offense for which he has been sentenced to a penalty of more than eighteen months or for a crime involving moral turpitude, shall be disqualified to be a candidate and to hold any office, unless he has been given plenary pardon or granted amnesty.”
Matatandaan na si Capinig ay hinatulan ng ‘’Guilty Beyond Reasonable Doubt’’ ng RTC Br 47 noong Abril 18, 2023 sa paglabag sa section 31 ng RA 10591 o illegal possession of firearms and ammunition at nasentensiyahan.
Na-flagged down ito sa Brgy Panique sa ikinasang checkpoint ng mga awtoridad at nakuhanan ng kalibre .45 na pistol na kargado ng 7 bala at extra na 15 pirasong bala para sa kaparehong baril.
Ang desisyon ay pinagtibay ni Comelec Presiding Commissioner Marlon Casquejo.
