ICC declares Rodrigo Duterte fit to stand trial

The International Criminal Court has declared former Philippine President Rodrigo Duterte fit to stand trial, clearing the way for proceedings scheduled to begin Nov. 30, 2026.

In a decision by Trial Chamber III, the ICC said reports from an expert panel provided sufficient basis to determine that Duterte could understand the charges against him, the trial process and the evidence to be presented before the court.

The ruling addresses Duterte’s ability to participate in the proceedings and understand the legal case against him.

The ICC Registry has been directed to prepare special arrangements for his participation in the trial.

These measures include shorter hearing sessions and the possibility of Duterte appearing by video from the ICC Detention Centre. His condition will also continue to be monitored throughout the proceedings.

The court may also allow Duterte to communicate privately with his lawyers while the trial is ongoing.

The arrangements are intended to accommodate his participation in the proceedings, according to the details provided in the court’s announcement.

The trial is scheduled to begin on Nov. 30, 2026. The ICC’s determination that Duterte is fit to stand trial means the proceedings can move forward under the planned arrangements.

The decision does not determine Duterte’s guilt or innocence. Those questions will be addressed through the judicial process.
