Supreme Court budget ruling may figure in new Marcos impeachment bid

Navotas City Rep. Toby Tiangco said a group had approached him about the possibility of filing a new impeachment complaint against President Ferdinand Marcos Jr. next year, citing a Supreme Court ruling on budget appropriations.

Tiangco said the group was considering using the high court’s ruling on unprogrammed appropriations as a basis for a complaint after the one-year bar on impeachment proceedings expires in February.

He stressed that the Office of the Solicitor General should file a motion for reconsideration to seek clarification from the Supreme Court regarding its declaration that certain provisions of the 2024 and 2025 General Appropriations Acts were unconstitutional.

Tiangco also said the government should explain why Marcos did not exercise his veto power if provisions in the national budget were considered improper.

The lawmaker acknowledged that there might not be enough time to resolve the motion for reconsideration before the 2027 national budget deadline of Dec. 31.

He also said the Senate would likely impose stricter scrutiny on its version of the General Appropriations Bill.

Tiangco recommended that the executive branch immediately seek corrections through the Senate if it identifies provisions that are erroneous or inconsistent with the Supreme Court ruling.

The Supreme Court declared the 2024 General Appropriations Act unconstitutional in connection with Congress’ increase in unprogrammed appropriations, which exceeded 449 billion pesos, according to the report.

The ruling also covered the increased Special Road Fund under the 2025 budget and special provisions in the 2026 General Appropriations Act.

The possible impeachment complaint remains under consideration by the group mentioned by Tiangco. No formal filing was confirmed in the information provided.
